Terms & Conditions

The terms that govern migration and education services provided by Genuine Migration & Education Australia.

1. About Us

Genuine Migration & Education Australia (ABN: 32 693 382 697) is a MARA-registered migration agency based in Adelaide, South Australia. Our registered agents are Jeevan Kumar (MARN 2418470) and Zixuan Owen Yang (MARN 1808753). All services are provided in accordance with the Migration Agents Registration Authority (MARA) Code of Conduct.

2. Services

We provide migration advice, visa application services, and education services. The specific services, fees, and terms applicable to your matter are set out in the written service agreement executed with each client prior to commencement of work.

All migration advice is provided by MARA-registered agents only. We do not provide legal advice as defined by state or territory legal profession legislation — our services are migration agent services governed by the Migration Agents Registration Authority.

3. Service Agreement

Before commencing work on any matter, we will provide you with a written service agreement setting out:

  • The scope of services to be provided
  • Our agent fees (exclusive of government fees and charges)
  • Government fees applicable to your matter
  • The terms for payment
  • What happens if you wish to cancel the engagement
  • What happens if your application is refused

Work will not commence until the service agreement is signed and any required deposit is received.

4. Fees and Payment

Our agent fees are set out in the service agreement applicable to your matter. Government fees — including visa application charges, skills assessment fees, and any other charges payable to government authorities — are in addition to our agent fees and are payable separately unless otherwise specified.

We do not guarantee any particular outcome, and our fees are not contingent on the outcome of any application.

5. No Guarantee of Outcome

We cannot guarantee that any visa application will be successful. Visa decisions are made by the Department of Home Affairs, the Administrative Review Tribunal, or other relevant authorities, and are outside our control. We will provide honest advice on the prospects of your application based on available information and our professional assessment — but that assessment is not a guarantee of a particular outcome.

6. Client Obligations

To enable us to provide services effectively, you agree to:

  • Provide complete and accurate information when requested
  • Advise us promptly of any change in your circumstances that may be relevant to your application
  • Respond to requests for information or documents in a timely manner
  • Not provide false or misleading information to us or to any government authority in connection with your application

Provision of false or misleading information may result in visa refusal, cancellation, or other serious consequences — and may constitute a criminal offence under the Migration Act 1958. We will not assist with, and will not be responsible for, the consequences of any misleading or fraudulent information.

7. Confidentiality

All information provided by clients is treated as confidential and will not be disclosed to third parties except as necessary to provide the services you have engaged us for, or as required by law. Our full privacy practices are set out in our Privacy Policy.

8. Cancellation

You may cancel our engagement at any time by providing written notice. Our cancellation terms — including fees payable for work already completed and any refund provisions — are set out in your service agreement. Government fees that have already been paid to the Department of Home Affairs or other authorities are generally non-refundable regardless of the outcome or cancellation.

9. MARA Code of Conduct

All services are provided in accordance with the Migration Agents Code of Conduct as prescribed under the Migration Act 1958. If you have a complaint about our services, please contact us first at adelaide@genuinemigration.com. If your complaint is not resolved, you may refer it to MARA at mara.gov.au.

10. Limitation of Liability

To the extent permitted by law, our liability for any loss or damage arising from our services is limited to the agent fees paid by you for the specific matter in which the loss or damage arose. We are not liable for consequential, indirect, or special loss or damage.

11. Governing Law

These terms are governed by the laws of South Australia and the Commonwealth of Australia. Any disputes will be subject to the jurisdiction of the courts of South Australia.
